Does anyone have an example form of the I-1864 A form?

Note this is NOT a Joint Sponsor's form, a Joint sponsor files an I-864, I-864A is a Contract Between Sponsor (Or Joint Sponsor) and Household Member to add the income of household member to that of the Sponsor or Joint-sponsor.

 

A few cases where an I-864A is used:

  • K-3 Enters the USA and applies for an EAD BEFORE they file an I-485 to adjust status, the K-3 then gets a job and works, the K-3 can then ADD their income to that of their sponsoring spouse when adjusting status. K-3 provides an I-864A and sponsoring spouse provides an I-864.
  • Non-Immigrant in USA on a work visa marries a US citizen and adjusts status the NON-Immigrant can add their income to sponsoring spouse like the K-3 above.
  • Student living in USA gets an EAD to be able to work, Student then marries a US citizen and adjusts status, refer to the two scenarios above.
  • A joint sponsor is married and files taxes jointly, the Petitioner provides an I-864 as primary sponsor, and Joint-sponsor provides and I-864 and joint sponsor's spouse provides an I-864A.
  • Petitioning sponsor has a working son or daughter that is still a household member the son/daughter can add their income to sponsor's income to help sponsor immigrant.

Which form would be the joint sponsor form? I need a family member to help me sponsor since I cannot satisfy the 125% poverty level on my own. I thought I-864 was for the petitioner, and I-864 A was for anyone who helps sponsors the petitioner and the immigrant. :lol: "confusion kicks in"

Joint sponsor also files an I-864 the I-864 has a box that says "Joint Sponsor"

 

I-864A is only for household members to ADD their income to a sponsor or joint sponsor, I-864A is NOT a joint sponsor form.

Will I as the petitioner for my spouse, also have to file the I-864 form as-well though I do not meet the 125% poverty line? Will I have to reside with the joint sponsor, after arriving in America with spouse?

Yes you as petitioner MUST be primary sponsor, you must provide an I-864 even though you dont meet the income level required.

 

Your Joint sponsor also provides an I-864 as a joint sponsor.

 

You are not required to live with your joint sponsor, Joint sponsor can even live in a different state.

Ok got it now. Thanks a mil! Hopefully I'll be handing in the I-130 form soon. Can't wait >_< I just need to verify some other things before we start. Once again thanks to CFL for all the education!

Note: If filing I-130 to USCIS in the USA the I-864 is not filed with the I-130 it will be requested by NVC after USCIS approves the I-130. If filing petition DCF in China, the I-864 will be needed at the visa interview.

I will DCF here in China at Beijing. I do not need to summit the I-864 until spouse goes to final interview? Also do I prove domicile together with the I-864, or prove domicile when I hand in the I-130?

You provide the I-864 at the visa interview, and you need to prove that you maintained US Domicile. You show US Domicile when you hand provide the I-864.
